Traffic Cases

Jurisdiction – All traffic offenses committed by a juvenile (one who is under 18 years of age).

Court Calendar – Matters regarding traffic violations committed by a juvenile are heard on Friday 9:00 a.m and Wednesday at 1 p.m.

Right to Counsel – The juvenile has a right to be represented by a lawyer. If you choose to hire a lawyer to represent the juvenile, you will be given a reasonable opportunity to hire, at your expense, a lawyer selected by you. The judge will decide what is a reasonable opportunity to hire a lawyer. If you have not hired a lawyer after such reasonable opportunity, the judge may try the case even though the juvenile does not have a lawyer to represent him. If you ask the judge for a lawyer to represent the juvenile and the judge decides, after reviewing your sworn financial statement(s), that you cannot afford a lawyer, the judge will select and appoint a lawyer to represent the juvenile. However, if the juvenile or the parents are financially able to pay, the juvenile or the parents may be required to pay the lawyer’s fee as set by the judge within statutory limits. The appointment of an attorney in traffic cases is limited to offense for which incarceration is a disposition, such as reckless driving, driving under the influence, driving without or on a suspended drivers license.

Right to appeal – If you wish to appeal your case you must do so within ten (10) calendar days of the entry of the final order in writing.

Prepayment of Fines and Costs – Certain traffic offenses may be prepaid in advance of your court date by making payment at the Juvenile Court Clerk’s Office or mailing your payment to the court:

Effective January 1, 2001 fines that are listed in the prepayable schedule and involve an accident may now be prepaid. The Code of Virginia, 1950, as amended, states that you may enter a written appearance, waiver of court hearing, plea guilty, and pay fines and costs for those offenses listed in the Uniform Fee Schedule set out in Rule 3B:2 of the Rules of Virginia Supreme Court.

You may not pay all offenses listed in the Uniform Fee Schedule. Alcohol related offenses, such as drunk in public and possession of alcohol are not prepayable. If you plan to prepay an offense, it is recommended that you contact the Clerk’s Office, (804) 501-4688. The police officer or state trooper checks a box on your summons if you are able to prepay this ticket.

You are responsible for the fines, court costs and signing your traffic ticket in the section titled ‘Waiver of a Trial’ if you plan to prepay your ticket. By signing you are certifying that you are entering your written rather than personal appearance and you are giving up your right to trial and entering a plea of guilty to the violation on your summons. If you mail the form, or appear at the Clerk’s Office to pay your fine without your parent, your parent will need to sign your summons. Your parent’s signature will need to be notarized.

It is your responsibility to see that your payment is processed by the Clerk’s Office prior to the trial date. The Court will not accept prepayment unless you comply with all procedures. Failure to do so may result in additional consequences such as higher costs, loss of license, or even arrest.
